FormConnect respects the privacy of all members of our communities. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit the FormConnect application or our website at FormConnect.com. Updates in this version of the Privacy Policy reflect changes in data protection law. In addition, we have worked to make the Privacy Policy clearer and more understandable by:

  • organizing it into the sections listed in the Table of Contents below,
  • providing a series of examples that help illustrate how the policies may be implemented by FormConnect and
  • defining and capitalizing a few terms that are used more than once for simplicity and brevity.

Applicability of This Privacy Policy

This Privacy Policy applies to FormConnect's online form management platform and professional services (the “Services”), FormConnect.com and other interactions (e.g., customer service inquiries, etc.) you may have with FormConnect. If you do not agree with the terms, do not access or use the Services, Websites or any other aspect of FormConnect's business.

This Privacy Policy does not apply to any third party applications or software that integrate with the Services through the FormConnect platform, or any other third party products, services or businesses. In addition, a separate client agreement governs delivery, access and use of the Services (typically, the “Customer Terms of Service”), including the processing of any messages, files or other content submitted through user accounts (collectively, “User Data”).

The organization (e.g., the school or organization you are affiliated with, herein referred to as "Client") that entered into the client agreement controls their instance of the Services (their “Instance”) and any associated User Data. If you have any questions about specific Instance settings and privacy practices, please contact the Client whose Instance you use. If you have received an invitation to join an Instance but have not yet created an account, you should request assistance from the Client that sent the invitation.

Information We Collect and Receive

FormConnect receives, collects and stores information about you and other users to provide the Services that our Clients, you and our other users request. We may obtain personal information about you from the following sources:

  • Our Clients who provide information about individuals affiliated with them (for example, current or former participants enrolled in a class or program); and
  • You, when you express an interest in learning more about FormConnect, register for an account or use FormConnect’s Services.
  • Other users, for example if a group leader is updating contact information for members of their group.

The personal information collected by FormConnect includes the following types of information depending on the Services you use:

  • User Data
    • Profile Data: Your name, email address(es), social media profile links, home and /or work address, phone numbers, date of birth and any bio information you share within your profile.
    • Collection of data on minor/child.
  • Usage Information: Your use of FormConnect Services, including website pages visited on the FormConnect website. More specifically:
    • Cookie Information. FormConnect uses cookies and similar technologies in our Websites and Services that help us collect Usage Information.
    • Services Metadata. When an authorized user interacts with the Services, metadata is generated that provides additional context about the way Authorized Users work. For example, FormConnect logs the Instances, people, features, forms, content and links you interact with.
    • Log data. As with most websites and technology services delivered over the Internet, our servers automatically collect information when you access or use our Websites or Services and record it in log files. This log data may include the Internet Protocol (IP) address, the address of the web page visited before using the Website or Services, browser type and settings, the date and time the Services were used, information about browser configuration and plugins, language preferences and cookie data.
    • Device information. FormConnect collects information about devices accessing the Services, including type of device, what operating system is used, device settings, application IDs, unique device identifiers and crash data. Whether we collect some or all of this other information often depends on the type of device used and its settings.
    • Location information. We receive information from you, our Client and other third-parties that helps us approximate your location. We may, for example, use a home address submitted by our Client, or an IP address received from your browser or device to determine approximate location. FormConnect may also collect location information from devices in accordance with the consent process provided by your device.

How We Use Information

The Profile Information and Engagement History we collect, combined with our software platform, lets our clients provide an online resource to deliver, manage and store required forms with their constituents. Constituents can include alumni, members, current participants or students, staff, employers or others, as designated in our client’s guidelines. These guidelines should also explain the approval or invitation process for new members.

We only use credit card and other financial information you provide for per-form fee transactions, enrollment fees, or other financial transactions you request and do not store or share this information for future use.

We collect usage information about your computer hardware, software, IP address, browser type, domain name, access time, referring website address and other similar technical information for operation of the FormConnect service, to maintain and improve the quality of the service, and to provide general usage statistics regarding the FormConnect website. FormConnect also tracks your engagement on some pages and features to determine which of our services are most popular.

Additionally, we use User Data and Usage Information:

  • To provide, update, maintain and protect our Services, Websites and business.
  • As required by applicable law, legal process or regulation.
  • To communicate with you by responding to your requests, comments and questions. If you contact us, we may use your User Data to respond.
  • To send emails and other communications. We may send you service, technical and other administrative emails, messages and other types of communications. We may also contact you to inform you about changes in our Services, our Services offerings, and important Services-related notices, such as security and fraud notices. These communications are considered part of the Services and you may not opt out of them.
  • For billing, account management and other administrative matters. If you are a FormConnect Client, we may need to contact you for invoicing. If you are a Client or a User, we may need to contact you for account management and similar reasons.
  • To investigate and help prevent security issues and abuse.

We do not share or sell any of your Profile Data or Usage Information to any third party advertisers or content providers.

If Information is aggregated or de-identified so it is no longer reasonably associated with an identified or identifiable natural person, FormConnect may use it for any business purpose. To the extent Information is associated with an identified or identifiable natural person and is protected as personal data under applicable data protection law, it is referred to in this Privacy Policy as “User Data.”

Use of Cookies

The FormConnect website uses cookies to help personalize your online experience. A cookie is a text file that is placed on your hard disk by FormConnect’s web server. Each cookie stores a different type of information for a different purpose.

FormConnect uses cookies to provide convenience features to you. For example, if you don’t want to log in every time you visit the site, a cookie enables us recall your specific information on future visits.

As part of our GDPR Compliance initiative, you will have the ability to accept or decline cookies when you visit a site hosted by FormConnect. Most web browsers automatically accept cookies, but you can modify your browser settings to decline cookies if you prefer. If you choose to decline our cookies, you may not be able to fully experience the interactive features of FormConnect’s websites.

Access, Update, and Correction of Personal Information

Upon your request, FormConnect will provide you with information about what personal information we hold regarding you. You may view, update, correct or delete most of your Profile Data by logging into your FormConnect account and navigating to "Edit Profile".

Upon your request, FormConnect will correct, delete or supplement your personal information as long as such action is allowed under applicable law, and such action is technically feasible, does not compromise FormConnect’s legal obligations, and does not impose an undue burden or expense. To request access, correction or deletion, please email support@FormConnect.com.

Data Retention

If your account becomes inactive or you choose to cancel your account, FormConnect will retain your information as necessary to comply with FormConnect’s legal obligations, to resolve known or reasonably anticipated disputes, and enforce or defend FormConnect’s contractual rights. FormConnect retains User Data and Usage Information for all community members in accordance with a Client's instructions, including any applicable terms in the Client Agreement and as required by applicable law.

The termination of a Client relationship may result in the deletion and/or de-identification of the Client's associated User Data. FormConnect may retain Usage Information pertaining to you for as long as necessary for the purposes described in this Privacy Policy. This may include keeping Usage Information after you have deactivated your account for the period of time needed for FormConnect to pursue legitimate business interests, conduct audits, comply with (and demonstrate compliance with) legal obligations, resolve disputes and enforce our agreements.

How We Share and Disclose Information

We do not sell your personal information. In addition, we do not share your personal information with anyone other than the Client(s) who provided your information to us without your consent.

If you perform a financial transaction on our site, we securely transmit your credit card information or other financial information to our payment processor and/or other institutions as necessary to complete the requested transaction.

From time to time, FormConnect may provide anonymous information to trusted partners regarding use of the FormConnect site for purposes such as statistical analysis, mapping services, or social media feeds. This anonymous information is not personally identifiable and third parties who receive this anonymous information are prohibited from using your information except to provide services to FormConnect.

FormConnect may disclose your information without your consent if FormConnect has a good faith belief that disclosure is: (a) required by law, valid legal process, or applicable court order; (b) necessary to protect or defend the rights or property of FormConnect or another person; or (c) to protect the personal safety of any person.

Security

FormConnect takes commercially reasonable measures to help protect information about you from loss, theft, misuse, unauthorized access, unauthorized disclosure, alteration and destruction. For example, when personal information (such as a credit card number) is transmitted to other websites, it is protected through the use of encryption, such as the Secure Sockets Layer (SSL) protocol.

You may access your account information only through use of an individual user ID and password. To protect the confidentiality of personal information, you must keep your password confidential and not disclose it to any other person. Please advise us immediately if you believe your password has been misused. Please note that we will never ask you to disclose your password in an unsolicited phone call or email.

No security protocols are 100% effective. FormConnect cannot guarantee your information, including your personal information, will not be accessed by unauthorized third parties. If FormConnect becomes aware of any breach of personal information affecting you, FormConnect will notify you promptly. In the event of a breach, FormConnect is prepared to respond with all commercially reasonable and appropriate measures.

Opt-Out and Unsubscribe

We respect your privacy and give you the opportunity to opt-out of receiving email communications from our clients, as well as messages from other community members. You can have your account turned off at any time by contacting an administrator in your community. Some system-generated notifications can not be turned off, such as delivery of forms from our Client or transactions or password reset requests.

To comply with the Telephone Consumer Protection Act (TCPA), FormConnect requires that our customers (senders) obtain from SMS recipients (participants/users) their express consent to receive SMS text messages from the FormConnect application. Senders must collect this consent directly from SMS recipients before sending any system generated communications via SMS delivery.

Links to Third Party Websites and Services

There may be links to external websites and services posted and shared in your FormConnect instance. FormConnect does not control those third party websites and we encourage you to review the privacy notices of those websites so you can understand how those websites collect, use and share your information. FormConnect is not responsible for the privacy or security practices of those third party websites.

Age Limitations

FormConnect Services are not directed to individuals under the age of 16. We do not knowingly collect personal information from children under 16. If you learn that anyone younger than 16 has unlawfully provided us with personal data, please contact us and we will takes steps to delete such information promptly.

Changes to this Privacy Policy

FormConnect may change this Privacy Policy from time to time. Laws, regulations and industry standards evolve, which may make those changes necessary, or we may make changes to our business. We will post the changes to this page and encourage you to review our Privacy Policy to stay informed. If we make changes that materially alter your privacy rights, FormConnect will provide additional notice, such as via email or through the Services. If you disagree with the changes to this Privacy Policy, you should deactivate your Services account. Contact the Client if you wish to request the removal of Personal Data under their control.

Identifying the Data Controller and Processor

Data protection law in certain jurisdictions differentiates between the “controller” and “processor” of information. In general, the Client is the controller of User Data (Profile Data and Engagement Data). FormConnect, LLC, an American company based in Connecticut, USA, is, in general, the processor of User Data and the controller of Usage Information relating to Authorized Users who use Instances established for clients located anywhere in the world. .

Your Rights

Individuals located in certain countries, including the European Economic Area, have certain statutory rights in relation to their personal data. Subject to any exemptions provided by law, you may have the right to request access to Information, as well as to seek to update, delete or correct this Information. You can usually do this using the settings and tools provided in your account. If you cannot use the settings and tools, contact support@FormConnect.com.
